Copyright and Privacy Policy

Wood Media is committed to delivering exceptional real estate photography and video marketing services, while ensuring the protection of intellectual property rights for all parties involved. This policy defines the copyright and privacy terms governing the photographs and video content produced by Wood Media, as well as the permissible use of such content by clients.

1. Introduction

This Copyright Agreement ("Agreement") is entered into between Tayla Wood Media ("Photographer") and the Client ("Client") as of the date of booking. This Agreement outlines the terms and conditions under which the Photographer's images will be used, licensed, and protected.

2. Copyright Ownership

All photographs, images, and digital content ("Images") created by the Photographer are protected under Australian Copyright Law. The Photographer retains full ownership and copyright of all Images unless otherwise explicitly agreed upon in writing.

3. Limited License to Use

Upon full payment of the agreed fee, the Photographer grants the Client a limited, non-exclusive, non-transferable license to use the Images solely for the purposes of marketing, advertising, and promoting the specific property for which the Images were commissioned. This includes online listings, print media, and promotional materials related to the sale or lease of the property.

4. Restrictions on Use

The Client is prohibited from using the Images for purposes other than those specified in this Agreement without the Photographer's prior written consent. Prohibited uses include, but are not limited to:

  • Reusing the Images for multiple properties.

  • Selling, licensing, or distributing the Images to third parties (e.g., other agents, developers, builders, etc.).

  • Altering, editing, or manipulating the Images in any way without the Photographer's consent, except for basic cropping and resizing for marketing purposes.

5. Credit and Attribution

Where possible and appropriate, the Client agrees to credit the Photographer in a reasonable manner when the Images are used for online or printed marketing materials.

6. Duration of License

The license to use the Images is valid for a period of five (5) years from the date of delivery unless otherwise agreed in writing. After this period, continued use of the Images requires a new licensing agreement.

7. Breach of Agreement

Any unauthorized use of the Images by the Client will be considered a breach of this Agreement. In the event of a breach, the Photographer reserves the right to revoke the Client's license and pursue any legal remedies available under Australian Copyright Law.

8. Indemnification

The Client agrees to indemnify, defend, and hold harmless the Photographer from any claims, damages, or expenses arising from the Client's use of the Images beyond the scope of this Agreement.

9. Amendments

This Agreement may only be amended or modified by a written agreement signed by both parties.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of South Australia.

11. Acceptance

By booking the Photographer's services and paying the required fee, the Client acknowledges that they have read, understood, and agreed to the terms and conditions of this Copyright Agreement.
